In a bold move designed to assist Storm clients, the Plain Truth has agreed to help a CBA victim at an individual level. The Plain Truth has been approached by a number of CBA victims who as yet are unrepresented by lawyers and are not in the CBA contrived and one-sided resolution scheme.
The Plain Truth has access to thousands of documents, including flawed reports from the so-called independent CBA appointed evaluators. This advantage will allow us to better establish a case from scratch and seek compensation for victims from the bank.
Given our extremely limited resources we can only handle one (1) victim at a time and will commence investigations and claims on the bank immediately. We are not sure how successful the bank will be at stalling us off but we do not believe that we can get worse outcomes than the lawyers have obtained to date.
Whilst the CBA has leverage and influence over most parties, particularly over the lawyers, given the way they have inserted themselves inside the legal fee structure, the banks have no influence whatsoever over The Plain Truth or anyone within our organisation. We also intend to commence at some point individual claims against ASIC and this should occur in the very near future.
Our thinking for the moment is to carry out a limited number of individual compensation claims publicly with all pieces of correspondence to and from both the bank and ASIC being published in The Plain Truths news articles as each chess move is played. By doing this we hope that a ‘routine’ will become evident to allow many others to follow the same template to successfully hold the bank and ASIC accountable.
As each pathetic excuse is put up by the bank or ASIC over the course of the campaign, we will respond, counter it and expose all duplicity. We expect in the end game that either a settlement will be offered or court action will be taken. We also expect that should the Commonwealth Bank make an offer, it will attempt to make it along the lines of the Damian Scattini formulated claims. Such offers will be rejected out of hand given our evidence that the Scattini formulated claims are really CBA formulated claims and profoundly deficient.
Unfortunately for all those who have signed deeds, any further claims against the CBA, although not impossible, will be difficult. There is hope however that even those who have signed deeds, as well as all other Storm clients / CBA victims, should have a valid claim against ASIC. We intend to vigorously pursue ASIC to come clean, accept responsibility and be accountable for its negligence against Storm clients.
